Complaints and Returns

 

You have the right to make a complaint, exchange or refund for any item purchased in our online store in accordance with the terms defined by the Consumer Protection Act.

 

Refunds

 

We provide refunds within 14 days of the purchase date. The customer must request a refund in writing and must attach the invoice to the refund request. We do not refund the cost of shipping or package handling when returning the product or any expenses incurred by delivery services, only the value of the product.

The customer is obligated to physically inspect the product upon receipt, but no later than 14 days, and report any visible defects. We do not accept subsequent complaints regarding the appearance of the product.

You can unilaterally terminate the contract within 14 days of signing it using the form mentioned above or any other unambiguous statement expressing your desire to terminate the contract on a durable medium.

 

If the customer terminates the contract for the purchase of a service (membership for the gym, group programs, diagnostics, personal trainer services), they are obliged to pay the total amount of all remaining monthly fees for the remaining period of the contract, unless otherwise agreed with the Company.

The notice period in the event of termination or cancellation of the contract by the customer for services lasts for 30 (thirty) days and begins on the 1st day of the month following the month in which it was expressed.

The customer can cancel and/or terminate the contract by personally visiting any of the company's gyms, presenting their ID and signing a request or completing a form sent to the company's email.

 

We do not refund money in the following cases:

  • For purchased or ordered services. In the case of purchasing a service (membership for the gym, group programs, diagnostics, etc.), terminating the contract in accordance with Article 86 of the Consumer Protection Act (NN 19/2022) entails payment of all remaining debts to the Company that the customer is obliged to settle under the contract.
  • For used but still functional products.
  • For products used for hygiene purposes that cannot be returned for legitimate hygiene reasons.
  • For products purchased with an error (if the error was clearly stated during the sale) or for items purchased in a sale.
  • For free or not-yet-paid-for items.

 

The returned product must be properly packaged in the original packaging with the invoice attached.

 

In situations where we suspect the possibility of abuse of these benefits, we reserve the right to investigate the matter and respond in writing to the request within 14 days of receiving it.

 

Products returned or exchanged must be in their original packaging, as received by the customer during purchase, and properly packaged. In the event that a customer insists on an exchange without the packaging, we will charge an additional fee of 20% of the item's value for products without packaging.

If the product is dirty, altered, modified, shortened, lengthened, or in any way different from its original condition at the time of purchase, we do not approve exchanges or refunds.

 

Complaints for used purchased items

In case the products become non-functional during use within 30 days, you have the right to file a complaint. The customer is responsible for ensuring delivery of the product to the address from which the package was received. The customer must include the invoice with the request. We reserve the right to inspect the product and the ability to make the product functional within 30 days. If we are unable to make the product functional, the customer will receive the same product and if for any reason we do not have the same product in stock, the closest equivalent product (considering the price paid and group) will be provided.

The customer also has the right, if not satisfied with the used purchased item, to receive a reduced purchase price when purchasing an item that they believe will be satisfactory. The amount of the price reduction is subjectively determined by us in this case.

It is not possible to receive a refund for used purchased items. We do not accept complaints for products that have been used but are still functional. For products purchased more than 30 calendar days ago (except for products for which such a type of warranty is specifically stated and certified), we do not accept any type of complaint or request.

 

Instructions for unilateral termination of the contract

You can unilaterally terminate the contract within 14 days without stating a reason.

In the case of purchasing a service (membership for the gym, group programs, diagnostics, personal trainer services), termination of the service contract in accordance with Article 86 of the Consumer Protection Act (NN 19/2022) entails the payment of all remaining debts to the Company.

In order to exercise the right to unilateral termination of this Contract, you must inform us of your decision to unilaterally terminate the contract before the expiration of the deadline, in an unambiguous statement sent by mail, fax, or email, or by using the unilateral termination of contract form. If the consumer exercises the right to unilateral termination, they will not incur any costs related to this except for the direct costs of returning the goods.

We will send you a confirmation of receipt of the notice of unilateral termination of the contract without delay by email.

1. Refund of the paid amount

If you unilaterally terminate this Agreement, we will refund the money we received from you without delay and no later than 14 days from the day we received your decision on unilateral termination of the agreement.

The refund will be made in the same way you made the payment. If you agree to a different way of refunding the paid amount, you will not incur any costs related to the refund.

We can only make the refund after the goods have been returned to us or after you provide proof that you have sent the goods back to us.

2. Return of goods

Please return the goods to us without undue delay, and in any case no later than 14 days from the day you sent us your decision on unilateral termination of the agreement.

It is considered that you have fulfilled your obligation on time if you send or deliver the goods to us before the above-mentioned deadline.

3. Costs of returning the goods

You must bear the direct costs of returning the goods.

4. Consumer's responsibility for the reduction of the value of the goods

You are responsible for any reduction in the value of the goods that is a result of handling the goods, except for that which was necessary to determine the nature, characteristics, and functioning of the goods.

The filled Agreement for unilateral termination of the agreement can be sent by email to the Company or by regular mail to the Company Address 

 

Responsibility for material defects

Responsibility for material defects will be handled in accordance with the Law on Obligations.

 

Right to complaint
